वे इस बात पर सहमत थे कि पूर्वी सागर / दक्षिण चीन सागर में नौवहन की आजादी में कोई बाधा नहीं आनी चाहिए तथा उन्होंने संबंधित पक्षों से संयम बरतने, बल प्रयोग की धमकी देने या बल प्रयोग करने से परहेज करने तथा यू एन सी एल ओ एस समेत अंतर्राष्ट्रीय कानून के सार्वभौमिक रूप से स्वीकृत सिद्धांतों के अनुसरण में शांतिपूर्ण ढंग से विवादों का समाधान करने का आह्वान किया।

70. The vision of a South Asian community must include as an essential component the idea of a South Asia free from violence and disputes, at peace with itself, free to concentrate on its primary tasks of abolishing poverty, improving the life of its people as well as seeking common prosperity.

दक्षिण एशियाई समुदाय की संकल्पना में हिंसा और विवादों से मुक्त दक्षिण एशिया का विचार अनिवार्यत: शामिल है जिसमें शांति हो, गरीबी उन्मूलन, अपने लोगों के जीवन स्तर में सुधार और साझा समृद्धि के प्राथमिक कार्य पर स्वतंत्र रूप से ध्यान दे सके ।

71. India hopes that all parties to the disputes in the South China Sea will abide by the guidelines on the implementation of the Declaration on the Conduct of Parties in the South China Sea, and redouble efforts for early adoption of a Code of Conduct on the basis of consensus.

भारत आशा करता है कि दक्षिण चीन सागर विवाद के सभी पक्षकार दक्षिण चीन सागर में पक्षकारों के आचरण पर घोषणा के कार्यान्वयन से संबंधित दिशानिर्देशों का पालन करेंगे और सर्वसम्मति के आधार पर जल्दी से आचार संहिता अपनाने के लिए अपने प्रयासों को और दोगुना करेंगे।

72. In the previous summit meetings, India had underlined that maintaining peace on the border is a prerequisite to building better relation and actualising the full potential of the India-China relations, which remain underleveraged largely due to a lingering trust deficit stemming from the unresolved boundary dispute.

विगत शिखर वार्ताओं में भारत ने इस बात को रेखांकित किया था कि बेहतर संबंध कायम करने और भारत-चीन संबंधों की पूरी संभावनाओं को मूर्त रूप देने के लिए सीमा पर शांति बनाए रखना एक पूर्वापेक्षा है, जो मुख्यत: अनसुलझे सीमा विवाद से पैदा हुई विश्वास की कमी के कारण अधूरी की अधूरी रह गई है।

73. They agreed that freedom of navigation in the East Sea/South China Sea should not be impeded and called the parties concerned to exercise restraint, avoid threat or use of force and resolve disputes through peaceful means in accordance with universally recognized principles of international law, including the UNCLOS-1982.

वे इस बात पर सहमत हुए कि पूर्वी सागर / दक्षिण चीन सागर में नौवहन की आजादी में बाधा नहीं आनी चाहिए तथा संबंधित पक्षों से संयम बरतने, बल प्रयोग की धमकी देने या बल का प्रयोग करने से परहेज करने और यू एन सी एल ओ एस – 1982 समेत अंतर्राष्ट्रीय कानून के अंतर्राष्ट्रीय स्तर पर स्वीकृत सिद्धांतों के अनुसरण में शांतिपूर्ण ढंग से विवादों का समाधान करने का आह्वान किया।

74. One of the purposes of the United Nations as elaborated in Article 1 (1) of the Charter was to "bring about by peaceful means, and in conformity with the principles of justice and international law, adjustment or settlement of international disputes or situations which might lead to a breach of the peace.”

जैसा कि उक्त चार्टर के अनुच्छेद 1 (1) में कहा गया है, संयुक्त राष्ट्र के अनेक उद्देश्यों में से एक है ''शांतिपूर्ण तरीके से और न्याय तथा अंतर्राष्ट्रीय कानून के सिद्धांतों के अनुरूप ऐसे अंतर्राष्ट्रीय विवादों अथवा परिस्थितियों का समायोजन अथवा समाधान करना जिनसे शांति भंग होने की संभावना है।’’

75. This takes the adjudication of disputes relating to the recruitment and conditions of service of persons appointed to public services or posts of the union and of the states out of the hands of the Civil Courts and High Courts and puts them into those of the Administrative Tribunals for the Union or for the state .

इसने लोक सेवाओं या संघ और राज्य के पदों पर नियुक्त व्यक्तियों की भर्ती और सेवाशर्तों से संबंधित विवादों के न्यायनिर्णयन को सिविल न्यायालयों और उच्च न्यायालयों के पास से निकालकर संघ के या राज्यों के प्रशासनिक अधिकरणों के हाथ में दे दिया है .

76. Unless their jurisdiction is curtailed or abrogated by any special law , the civil courts are the forum for deciding any and every kind of civil dispute between individuals , between individuals and public authorities , whether of the Government of India or of the state governments , or any other authority constituted or created by any law .

जब तक उनकी अधिकारिता में कमी न कर दी जाए अथवा उसे निराकृत न कर दिया जाए तब तक सिविल न्यायालय प्रत्येक प्रकार के सिविल विवाद का निर्णय करने में सक्षम न्यायालय हैं - ये विवाद चाहे व्यक्तियों के बीच हों , व्यक्तियों और लोक प्राधिकारियों के बीच हों , ये प्राधिकारी भारत सरकार के हों चाहे राज्य सरकारों के अथवा विधि द्वारा गठित या विरचित किसी अन्य प्राधिकारी से संबंधित हों .

77.
